Terms and conditions of sale

1. Scope of application

The present terms and conditions apply to contracts concluded between Copernicus Map, represented by Christophe Penners, whose offices are located avenue de Bâle 3, 1140 Evere - and its customers and "the buyer": any individual or legal entity that has a contractual relationship of any kind with Copernicus Map.

By validating the order or accepting the order confirmation, the purchaser expressly acknowledges having read and accepted these terms and conditions.

2. Offer

The essential characteristics of the products and other articles, the price of the good, as well as the delivery costs are described, without ambiguity, in a clear and comprehensible way on the card relating to each product.

The photographs and illustrations accompanying the products on the website have no contractual value.

Slight differences may appear between the goods presented on the Copernicus Map website and those delivered to the consumer (differences in shade, pattern, tone or color).

Our quotations are valid for 30 days. Orders placed after this period of 30 days from the date of our quotation must be confirmed by us.

The customer's signature on the quotation or order is binding.

Work and products are expressly limited to those specified in the offer, quotation or order.

Additional work and products, as well as any maintenance work, will be the subject of a supplementary estimate accepted in advance.

3. Intellectual property of our products

Our quotations, drawings, plans, models, descriptions and working documents remain our exclusive property.

Their reproduction and communication to other companies or third parties is forbidden and liable to damages.

They must be returned or destroyed if they are not followed by an order.

The purchaser shall be held solely responsible for any fraudulent use of the intellectual property rights of trademarks, trade names, acronyms, logos, drawings or photos used and reproduced by Copernicus Map at its request.

The latter must have previously obtained from the third party owner a right to regular use of the latter.

The copyrights of the images are not transferred with the sale of our products and remain the exclusive property of Copernicus Maps.

 

4. Prices

All prices are in euros and include all taxes - including 21% value-added tax.

If the buyer is a company, the price may be indicated exclusive of 21% VAT.

Offers are only valid while stocks last.

The buyer is obliged to pay the price communicated by Copernicus Map in the order confirmation.

Pricing errors, including obvious inaccuracies, can also be corrected by Copernicus Map after the contract has been formed.

Delivery costs are communicated to the buyer when the order is placed.

 

5. Payment

As all our work is carried out to order, payment is made as follows:

- Orders under €500 excl. VAT: at time of order: 100%.

- Orders over €500 excl. VAT: 60% at time of order

The balance must be paid by the customer before delivery or collection, or exceptionally by the due date shown on the invoice, without discount or deduction of any kind.

6. Credit card fraud and identity theft

Copernicus Map uses secure and highly protected payment systems. The maps credit cards accepted are detailed on the Web shop.

Copernicus Map is not responsible for any fraud or impersonation.

 

7. Suspension of work

In the event of non-compliance with payment terms, the company reserves the right to suspend work after giving the customer formal notice to meet its commitments.

 

8. Deadlines

Delivery times are given as an indication only, unless otherwise stipulated on the quotation.

We are released from any commitment relating to delivery times in the case :

- Where the terms of payment have not been observed by the customer,

- Late delivery of the work order,

- Modification of the work program,

- Additional work,

- Force majeure or events such as: war, pandemic, strike by the company or one of its suppliers, transport impediments, third-party demonstrations, fire, bad weather, machine breakdown or supplier shortages, etc.

 

9. Terms and conditions

We are only obliged to start work within the timeframe specified in our offer.

  

11. Receipt of goods

Goods and work will be accepted no later than 15 days after completion.

In the absence of such acceptance within 15 days of completion of the work, it will be deemed to have been accepted without reservation.

A storage fee of €15 (excl. VAT) per piece per day may be charged after this period.

The customer is responsible for the goods as soon as they are received in our workshop, before they are loaded by the customer or delivered by a third party.

Any claim or dispute must be made at the time of collection.

 

12. Terms of delivery

Copernicus Map selects and informs the consumer of the most efficient means of transport according to the country and furniture chosen (Professional delivery).

Upon delivery, the consumer must examine the conformity of the package/product, in the presence of the person making the delivery. The consumer must then submit any complaints, with photos of the damaged packaging and product(s), within 7 days of delivery.

Unless otherwise agreed in writing, delivery of the product takes place at the consumer's risk and at the first door step. 

The consumer must ensure that the place of delivery is accessible. Failing this, delivery costs, as well as product return costs, are borne by the consumer.  

If the configuration of the premises requires the use of lifting or other equipment, the consumer is responsible for bearing the cost.

 

13. Delivery charges

Delivery costs vary according to delivery location and product price.

Unless otherwise agreed in writing, the costs of delivery shall be borne by the consumer. 

These costs are made known to the customer when the order is placed and will be calculated on the basis of the delivery rates (professional delivery).

 

14. Delivery times

Estimated delivery times are given on the description sheet for each product.

These times will be confirmed when the order is placed.

These times are specific to each product and depend on the following factors:

  • Place of delivery (Belgium or other countries);

  • Depending on whether the product is in stock or out of stock.

In principle, delivery times vary between 3 and 10 days from the time the order is placed for products in stock at Copernicus Map.

Generally, delivery times are 3 to 10 days from order placement for out-of-stock/manufactured products. 

Delivery times are given as an indication and can never be considered as binding. 

Copernicus Map undertakes to make every effort to execute the contract on time.

Copernicus Map undertakes to inform the consumer of any changes in lead times during order processing.

 

15. If the consumer is absent on the day of delivery

The consumer must make every effort to be present when the product is delivered.

If the consumer is unexpectedly absent on the day scheduled for delivery, it is the consumer's responsibility to bear the cost of a second delivery.

 

16. Right of withdrawal

The consumer has the right to cancel the purchase of a standard product.

This right is exercised without penalty and without giving any reason.

The consumer has 14 calendar days to withdraw from the contract.

This period begins on the day the product is delivered to the consumer.

The consumer must clearly indicate to Copernicus Map that he/she renounces the purchase of the product.

The consumer's wish to withdraw from the contract must be notified to Copernicus Map by registered mail with return receipt to Copernicus Map, represented by Christophe Penners: Avenue des Gorges Bleues 36, 1150 Brussels (Belgium).

The consumer will receive confirmation of the activation of the return procedure by e-mail.

The product must be returned to Copernicus Map by the consumer, within a maximum of 10 working days following expiry of the 14-day period referred to above, in its original packaging, accompanied by the accessories and instructions for use enclosed with it and the invoice.

In the event of retraction, the direct costs of returning the product shall be borne entirely by the consumer.

No returns will be accepted:

  • If the returned items have been visibly used or damaged by the customer and this use or damage renders the items unfit for sale.

  • If the original packaging is not intact.

On receipt of the product, Copernicus Map checks the conformity of the parcel, the packaging, the product's working order, etc.

Copernicus Map will refuse the return of any goods that do not comply.

Copernicus Map may claim compensation in the event that the consumer has used the product beyond what is necessary to exercise his right of withdrawal.

If the consumer exercises the right of withdrawal within the time limit, Copernicus Map is obliged to reimburse the sums paid by the consumer.

This reimbursement must be made no later than thirty days after retraction.

The consumer may not exercise the right of withdrawal for contracts for the supply of goods made to the consumer's specifications or clearly personalized or which, due to their nature, cannot be returned or are likely to deteriorate rapidly.

This is the case when Copernicus Map sells a product made to measure or adapted to the customer's specific requirements, for example: choice of a particular material, choice of a particular color, size or graphics, manufacture of an object according to the customer's wishes, etc.

 

17. Penal clauses

In the event of breach of contract, attributable to the customer, before completion of the work ordered, the deposit paid at the time of order will be retained as lump-sum compensation.

To this sum will be added the amount of supplies and equipment already ordered. In the event of termination of the contract during the course of the work, a lump sum equal to 15% of the amount of the quotation or order including VAT, with a minimum of 50 euros, will be added to the invoice for the work carried out.

Invoices and/or fee notes are payable on the due date indicated on the invoice. Any delay in payment will give rise, ipso jure and without any formal notice being required, to : Compensatory interest at the rate stipulated in article 5 of the law on combating late payment in commercial transactions of August 2, 2002. A contractual indemnity fixed at 15% of the unpaid amounts, with a minimum of 50.00 EUR. The interpretation and execution of the agreement are governed by Belgian law. Any dispute of any nature whatsoever shall fall within the jurisdiction of the courts and tribunals of the district in which Copernicus Map is established.

 

18. Reservation of title

Delivered goods remain our property until full payment has been received. However, the risks are transferred as soon as the goods are delivered or collected.

If payment is not received within the stipulated period, we reserve the right to take back the goods delivered and, at our discretion, to rescind the contract.

 

19. Assignment of powers

In the event of a dispute, the French-speaking courts of Brussels shall have exclusive jurisdiction.

 

20. Warranty

As required by the relevant legal provisions, a two-year legal warranty applies to products supplied by Copernicus Map.

If the product delivered does not conform to the contract, the buyer must notify Copernicus Map within seven working days of delivery. Any ensuing compensation may never exceed the amount invoiced to the buyer.

The following circumstances are expressly excluded from the warranty:

- Lack of original invoice or valid proof of payment

- Problems arising from accidents in the home or during transportation of the item by the customer.

- Damage caused by incorrect assembly or improper use of the product.

- Maintenance not in accordance with recommended methods.

- Wear and tear deemed unnatural and normal in relation to time of use.

- A defect well known to the buyer at the time of sale.

- Prolonged exposure to natural, chemical or physical elements that may discolor, degrade or deform the item (e.g. chemicals, sun, rain, overloading, etc.).
